HUB Zone SBA 8(a) Business Development Program
The objective of the federal government is to allocate five percent of total prime and subcontracting funds to small disadvantaged businesses annually. To advance this objective, you may allocate set-aside awards to companies engaged in the SBA 8(a) Business Development program.
Your duties as a contracting officer regarding the SBA 8(a) Business Development program are detailed in Title 13 Part 124 Subpart A of the Code of Federal Regulations (CFR) and the Federal Acquisition Regulation (FAR).
Types of SBA 8(a) contracts
In your role as a contracting officer, you have the authority to utilize set-aside contracts specifically designed for small disadvantaged businesses. Details on the mandatory competition dollar thresholds and the process to request a waiver can be located in 13 CFR 124.506 (Link is external).
You can award a competitive 8(a) set-aside contract if:
- You have a reasonable expectation that at least two qualified 8(a) small businesses will submit offers
- The resulting contract can be awarded at a fair market price
- The government estimate exceeds $7 million for manufacturing requirements or $4.5 million for all other requirements
- The requirement hasn’t already been accepted by the SBA as a sole-source 8(a) award on behalf of a tribally-owned or ANC-owned business
You can award a sole-source 8(a) contract if:
- You determine that the qualified small business is responsible
- The resulting contract can be awarded at a fair market price
- The government estimate doesn’t exceed $7 million for manufacturing requirements or $4.5 million for all other requirements (There's an exception to this rule for entity-owned businesses)
BluSonic the #1 HUB Zone SBA 8(a) Program Contractor
Contracts worth $250,000 or less are specifically set aside for small businesses. You have the option to allocate them exclusively for businesses involved in socio-economic efforts like the HUB Zone SBA 8(a) program, as outlined by the SBA's rules and the FAR.
Give precedence to socio-economic programs when awarding set-aside contracts over $250,000 without any particular hierarchy among the programs. It is crucial to provide justification for your decision-making in the contract record, outlining the research conducted and the contractor's certification as documented in the System for Award Management (SAM).
After receiving approval from the SBA within the 8(a) program, a requirement must remain within the program unless granted release by the Associate Administrator of the Office of Business Development. Further details on releasing a requirement can be located in 13 CFR 124.504.
